THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR USERS (“YOU” OR “USER”) OF THE APPLICATION ‘UPNEXT’ (THE “APP”) AND CONTENT FROM WEB DOMAIN THEUPNEXT.COM (THE “WEBSITE”, And COLLECTIVELY WITH THE APP, THE, “SITE”). BY USING THE SITE OR SERVICE YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS OF USE, PLEASE DO NOT USE THE PROPERTIES.
There is no general right to get access to UpNext and the usage is at one’s own risk. As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Use. You are responsible for all of your activity in connection with the Service. For purposes of the Terms of Use, the term “content” includes, without limitation, any User content submissions, music playlists or stations, written comments, information, data, photographs, image, video, audio, software, scripts, graphics, and interactive or non-interactive features generated, provided, or otherwise made accessible by The UpNext Inc, or its partners or through the service.
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the thereafter. Your continued use of the Site and Service following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
The UpNext Site and Service are available only to individuals who are at least 13 years old. You represent and warrant that if you are an individual, you are (i) at least 13 years old and (ii) if you are between the ages of 13 and 18, you have parental permission to enter into this Agreement and to use the Site and Service. We may, in our sole discretion, refuse to offer any portion of or all of the Site and/or Service to any person or entity or change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Sites and Services is revoked in such jurisdictions.
You should periodically review our Privacy Policy, which governs your visits to UpNext, to understand our information collection and use practices.
All of the UpNext site, service, apps and other website graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of The UpNext INC or its affiliates. You may not use our trademarks or trade dress in connection with any product or service that is not The UpNext INC's, or in any manner that is likely to cause confusion among customers. All other trademarks not owned by The UpNext INC or its affiliates that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by UpNext or its affiliates.
Proprietary Rights. The Service and all text, links, information, data, widgets, software, scripts, tools, photographs, graphics, interactive features, video and audio content provided thereon or in connection therewith (collectively, the “Content”) are protected as copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights under the copyright and other intellectual property laws of the United States and other countries, and we (subject to the rights of our licensors and licensees under applicable agreements, understandings and arrangements) have all rights therein. You must abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Service. We make no claims that Content contained on the Service may be lawfully viewed or downloaded. Access to Content on the Service may not be legally accessed or viewed by certain persons or in certain countries. If you access the Service from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. For the purposes of these Terms of Use, “Content” also includes all User Content (as defined below).
User Content. All Content added, created, uploaded, submitted, streamed, distributed, or posted to the Service by users (collectively “User Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. By posting or submitting Content on or to the Service (regardless of the form or medium with respect to such Content, whether text, videos, photographs, images, audio, profiles, data, comments, reviews or otherwise) or using any widget available through the Service, you hereby do and shall grant us, and our affiliates, agents and third party contractors a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable right and license to reproduce, display, perform, or publish such Content on the Service and in any media formats and through any media channels, including, without limitation, third party websites, feeds and on or in our affiliated publications (either in the form submitted or in the form of a derivative or adapted work), to store such Content, to distribute such Content, and to use, edit, modify and otherwise exploit such Content, including, without limitation, running paid advertising on or adjacent to any such Content and for promoting and redistributing part or all of the Application, Site or the Service (and derivative works thereof). However, we reserve the right to (i) remove, edit or modify any Content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if we are concerned that you may have violated these Terms of Use), or for no reason at all and (ii) remove or block any Content from the Service. We have sole and complete discretion over the programming of Content through the Service, including without limitation on widgets or syndicated units made available to publishers and other web sites, through implementation assistance from our personnel or otherwise made available by us. We may display on Applications, the Site and through the Service (including through any widgets or syndication units that you may use on other sites) paid Content, including without limitation paid advertisements sold by us or third parties.
We have adopted the following general policy toward copyright infringement in accordance with the Digital Millennium Copyright Act or DMCA. The address of our Designated Agent to Receive Notification of Claimed Infringement (“Designated Agent”) is listed at the end of this Section. It is our policy to (1) block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, Content providers, members or users; and (2) remove and discontinue service to repeat offenders.
Procedure for Reporting Copyright Infringements: If you believe that material or Content residing on or accessible through the Service infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below: (i) a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed; (ii) identification of works or materials being infringed; (iii) identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence; (iv) contact information about the notifier including address, telephone number and, if available, email address; (v) a statement that the notifier has a good faith belief that the material identified in (iii) is not authorized by the copyright owner, its agent, or the law; and (vi) a statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.
Once Proper Bona Fide Infringement Notification is Received by the Designated Agent: It is our policy: (i) to remove or disable access to the infringing material; (ii) to notify the Content provider, member or user that we have removed or disabled access to the material; and (iii) that repeat offenders will have the infringing material removed from the system and that we will terminate such Content provider’s, member’s or user’s access to the Service.
Procedure to Supply a Counter-Notice to the Designated Agent:If the Content provider, member or user believes that the material that was removed (or to which access was disabled) is not infringing, or the Content provider, member or user believes that it has the right to post and use such material from the copyright owner, the copyright owner’s agent, or, pursuant to the law, the Content provider, member, or user, must send a counter-notice containing the following information to the Designated Agent listed below: (i) a physical or electronic signature of the Content provider, member or user; (ii) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled; (iii) a statement that the Content provider, member or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and (iv) Content provider’s, member’s or user’s name, address, telephone number, and, if available, email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the Content provider’s, member’s or user’s address is located, or, if the Content provider’s, member’s or user’s address is located outside the United States, for any judicial district in which we are located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement. If a counter-notice is received by the Designated Agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Content provider, member or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.Please contact our Designated Agent to Receive Notification of Claimed Infringement at the email or physical address listed on this Site.
This Agreement shall remain in full force and effect while you use the Service. You may terminate your use of the Service at any time. We may terminate or suspend your access to the Service at any time, for any reason, and without warning. We may also terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach any of the terms or conditions of these Terms of Use. Upon termination, your right to use the Service, and access the Site and any Content will immediately cease. All provisions of these Terms of Use which, by their nature, should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.

In the event you are accessing the Service via an Application on a device provided by Apple, Inc. (“Apple”) or an Application obtained through the Apple App Store, the following shall apply:

We may amend this Privacy Policy from time to time. Use of Personal Information and other information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on our Service or sending you an email. The Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. The information we gather from users enables us to personalize and improve our Service. We collect the following types of information from our users.
Personal Information Collected Automatically: We receive and store certain types of information whenever you interact with our Service. We automatically receive and record information on our server logs from your browser including your IP address, cookie information, and the page you requested. If you access the Service through an Application, we may also collect your location information if you have selected settings that enable us to collect such information. Generally, our Service automatically collects usage information, such as the numbers and frequency of visitors to our Site and its components, similar to TV ratings that indicate how many people watched a particular show. We may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often users use parts of the Service so that we can improve and make the Service appealing to as many users as possible, and improve. As part of this use of information, we may provide aggregate information to our partners about how our users, collectively, use the Site and Application. Sign-In Information Collected: By creating an account or by signing in for the Service using a Third Party Service (as discussed below), you may provide us certain Personal Information, and you may allow others, including us, to identify you. Financial Information: We do not currently collect financial information, such as your payment method (valid credit card number, type, expiration date or other financial information); if and when we begin to collect, that information is collected and stored by our third party payment processing company (the “Payment Processor”), and use and storage of that information is governed by the Payment Processor’s applicable terms of service and privacy policy.
Third Party Services: As mentioned above, we may allow you to link your accounts to Third Party Services, such as Facebook, Instagram and Twitter (“Third Party Accounts“) to the Service. If you elect to link to such Third Party Services, we may collect information related to your use of that Third Party Service, such as access tokens made available by that Third Party Service, and other content or information that is provided to us from that Third Party Service. Third Party Services may also have the ability to restrict the information that is provided to us. Moreover, we don’t actually store your passwords for those Third Party Accounts. Instead, we just use an authentication token to verify your user name.
